Bylaw 8271 (July 8, 1986)

To establish a Site Specific Development Control District for a gas bar, convenience store and rapid drive-through vehicle service, such that by developing sensitive site development regulations, impacts on adjacent residential properties are minimized.

Lots 11-15 inclusive, Block 74, Plan 7251 A.D., West Jasper Place.

a. The maximum floor area ratio shall be 0.50.
b. The maximum building height shall not exceed 7 m or 1 storey.
c. A minimum landscaped yard of 3 m shall be provided adjacent to 149 Street to 95 Avenue and a 6 m landscaped yard shall be provided adjacent to 149 Street for the most northerly 16.5 m of Lot 15.
d. A minimum landscaped yard of 1.5 m shall be provided adjacent to the north property line. Such landscaped yard shall consist of deciduous shrubs and a mature deciduous tree every 7.6 m.
e. There shall be a minimum building setback of 16.5 m adjacent the north property line of Lot 15 and 10.5 m minimum building setback from the east property line.
f. Continuous screen fencing of a solid design, a minimum of 2.4 m in height, shall be provided adjacent to the north and east property lines and a 1 m berm with landscaping shall be provided along the south property line extending from the southeast corner 15 m westward.
g. The maximum gross floor area of a Convenience Retail Store shall not exceed 50 m2.
h. Gas Bars and Rapid Drive-through Vehicle Services shall be developed in accordance with Section 82 of the Land Use Bylaw and the following additional criteria:
 
i. Any application for a development permit for a rapid drive-through vehicle service shall be of a hand held or wand type operation and the development shall not include mechanical washing or drying equipment that is typical of an automatic car wash.
ii. A canopy shall be constructed over the gas pump islands to ensure that illumination is directed downwards away from direct view by adjacent residential uses. The canopy shall be designed and finished in a manner consistent with the design and finish of the principal building.
iii. All mechanical equipment associated with a rapid drive-through vehicle service shall be housed within an enclosed building.
i. No parking, loading, storage of trash collection, outdoor service or display area shall be permitted within a required yard. Loading storage and trash collection areas shall be located in the rear or sides of the principal building and will be screened from view from any adjacent sites or public roadways in accordance with the provisions of Section 69.3 of the Land Use Bylaw.
j. Signs shall be allowed in this District as provided for in Schedule 79D and in accordance with the general provisions of Sections 79.1 to 79.9 inclusive of the Land Use Bylaw.
k. Development in this District shall be regulated with respect to compliance with the General Development Regulations of Sections 50 to 79 inclusive of the Land Use Bylaw. In this evaluation, the Development Officer may grant relaxations to the regulations contained in Sections 50 through 79 and the provisions of this District if, in his opinion, such a variance would not affect the privacy, amenities, use and enjoyment of neighbouring properties.
