Rhatigan Ridge - south of 40 Avenue and west of Terwillegar Drive

To establish a Site Specific Development Control Provision to accommodate a limited range of convenience commercial and personal service Uses which are intended to serve the day-to-day needs of neighbourhood residents, with Site development regulations requiring the achievement of a residential character so that the development will be compatible with the surrounding residential land Uses.

This DC2 Provision shall apply to Lot 1, Block 107, Plan 862 1495, located south of 40 Avenue and west of Terwillegar Drive, as shown on Schedule A of this Bylaw, adopting this Provision, Rhatigan Ridge.

a. Development within this provision shall be in general conformance with the Site plan, as shown in Appendix I.
b. The maximum gross Floor Area of any individual business premise shall not exceed 275 m², except that the Development Officer may allow an individual business premise to have a gross Floor Area up to 465 m², provided that in his opinion the proposed business is primarily intended to serve residents of the neighbourhood and would not adversely affect the amenity and enjoyment of the surrounding residential land Uses.
c. The maximum Floor Area Ratio shall be 1.0.
d. The maximum building Height shall not exceed 10 m nor two Storeys, except that buildings located within 22 m of the western and southern property lines shall be a maximum of one Storey.
e. A minimum landscaped Yard of 3 m shall be required adjacent to the northern, western and eastern property lines.
f. A minimum Yard of 6.0 m shall be required adjacent to the southern property line and the Yard shall be intensively landscaped, in conjunction with the construction of a uniform screen fence, 1.82 m in Height, to substantially screen the commercial development from the residential area to the south.
g. All-directional access to the Site shall be permitted from 40 Avenue NW.
h. The overall design and finish of buildings shall achieve a residential character through compliance with the following criteria, to the satisfaction of the Development Officer:
 
i. all buildings facing 40 Avenue NW, Rhatigan Road East and the southern property line shall have sloped roofs and all building roofs shall be finished with cedar shakes, clay tiles or other roofing materials which achieve a similar character and colour, and are consistent with the roofing materials on surrounding homes;
ii. all mechanical equipment on the roof of any building shall be concealed by incorporating it within the building roof;
iii. all exposed building faces shall be finished in a consistent and harmonious manner with exterior finishes limited to muted earth tones with strong colours limited to use as accents. Exterior finishing material may include cedar, brick, stucco or similar masonry materials; and
iv. any buildings facing Rhatigan Road East and 40 Avenue shall include window and/or door details that are typical of residential structures in size, character and placement.
i. Signs are permitted in this Provision as provided for in Schedule 59D and in accordance with the general provisions of Section 59.1 to 59.3 inclusive of the Zoning Bylaw and the following additional criteria:
 
i. two freestanding signs shall be located in accordance with the attached Site plan, Appendix I; and
ii. the design, placement and illumination of signage shall be consistent with the intended residential character of the development and such that there is no adverse visual impact on surrounding residential properties, to the satisfaction of the Development Officer.
j. Parking, loading, storage, trash collection, outdoor service or display area shall not be permitted within a required Yard. Loading, storage and trash collection areas shall be located to the rear or side of the principal building and shall be screened from view from any adjacent Sites or public roadways in accordance with the provisions of Section 55.3 of the Zoning Bylaw.
k. Development in the Provision shall be evaluated with respect to compliance with the General Development Regulations of the Zoning Bylaw.
l. The Development Officer may grant relaxations to the Zoning Bylaw and the provisions of this DC2, if in his opinion such a variance would be in keeping with the general purpose of this Provision and would not affect the amenities, Use and enjoyment of neighbouring properties.
a. Child Care Services shall be developed in accordance with Section 80 of the Zoning Bylaw and shall be located such that direct access at grade can be provided to an outdoor play area. The outdoor play area shall be located away from vehicular-oriented Uses and from parking and loading areas on the Site and shall be enclosed by building walls or a screen fence, a minimum of 1.8 m in Height.
b. Gas Bars shall be developed in accordance with Section 72 of the Zoning Bylaw and shall:
 
i. be located a minimum of 30 m from the western and southern property lines;
ii. have any canopy constructed over the gas pumps designed to ensure that illumination is directed downwards and away from the direct view of surrounding residences. Such canopy shall be designed and finished in a manner consistent with the design and finishing of the principal buildings and the canopy shall not have any signage facing 40 Avenue; and
iii. have any gas pumps substantially screened from the view of surrounding residential areas by a combination of berming, Landscaping and/or fencing.
c. Residential Sales Centres shall be developed in accordance with Section 82 of the Zoning Bylaw.
d. Indoor Participant Recreation Services shall be limited to health and fitness clubs.
a. A Phase 1 Environmental Site Assessment for the entire Site must be completed and approved by the Development Officer in consultation with the City of Edmonton Environmental Planning Unit when a building addition or new building construction is proposed, excluding canopies and signage.
