Westmount - located at 10639 - 131 Street NW

Bylaw 16246 (October 1, 2012)

To accommodate the development of a commercial office within the existing single-detached dwelling on site and the opportunity to expand the existing single-detached dwelling on site that is compatible with, and maintains, the existing residential character of the surrounding neighbourhood.

Lot 8A, Block 51, Plan 4677HW, located at 10639 - 131 Street NW, as shown on Schedule "A” of the Bylaw adopting this Provision, Westmount.

a. The minimum Front Setback shall be 11.0 m.
b. The minimum Rear Setback shall be 18.0 m.
c. The minimum north Side Setback shall be 2.7 m.
d. The minimum south Side Setback shall be 2.9 m, except that a single-storey side entrance with a minimum Side Setback of 1.65 m from the south Lot Line shall be permitted in accordance with Appendix I to the satisfaction of the Development Officer.
e. The maximum Height shall not exceed 10.0 m nor 2 Storeys.
f. The maximum Gross Floor Area shall be 235 m2, excluding the basement.
g. The development shall be limited to the existing 2-storey structure and a 2-storey addition to the existing structure, in general accordance with Appendix I, to the satisfaction of the Development Officer.
h. The development shall maintain the external appearance of a single-detached dwelling comparable to neighbouring dwellings in order to retain the residential character of the neighbourhood to the satisfaction of the Development Officer.
i. Doors and windows on the south facade of the building addition shall be located and sized such that they minimize overlook into yards and windows of abutting properties to the satisfaction of the Development Officer.
j. Notwithstanding Section 4.i above, the following windows with the general dimensions and locations indicated below, shall be permitted to the satisfaction of the Development Officer:
 
i. a window located on the second storey, top-right corner of the south façade of the existing building – 1.4 m height x 1.3 m width;
ii. a window located on the main floor, one-storey entrance addition – 1.1 m height x 0.8 m width.
iii. a window located on the main floor, rear portion of the south façade of the existing building - 1.3 m height x 1.3 m width.
K. Notwithstanding Section 44 of this Bylaw, the following shall be permitted to project into the required Side Setback on the south side of the property, to the limits specified below, in accordance with Appendix I to the satisfaction of the Development Officer:
 
i. a deck and staircase – 2.5 m;
ii. a barrier-free access ramp – 2.5 m; and
iii. an emergency exit stairway from the second storey - 1.6 m.
l. Notwithstanding Section 44 of this Bylaw, the following shall be permitted to project into the required Front Setback, to the limits specified below, in accordance with Appendix I to the satisfaction of the Development Officer:
 
i. a deck and associated stairs – 1.0 m. 
m. Vehicular access to the site shall be from the rear lane.
n. Notwithstanding Section 54 of this Bylaw, six (6) vehicular parking spaces shall be provided in general accordance with Appendix I, to the satisfaction of the Development Officer in consultation with Transportation Services.
o. The parking area at the rear of the property shall be hard-surfaced.
p. Facilities for a minimum of one (1) bicycle parking space shall be provided within the building.
q. Notwithstanding Section 54 of this Bylaw, a loading space shall not be required.
r. Notwithstanding Section 55 of this Bylaw, Landscaping shall be provided in general accordance with Appendix I to the satisfaction of the Development Officer.
s. A solid screen, wood fence shall be provided and located as generally shown in Appendix I, and in accordance with Section 49 of this Bylaw to the satisfaction of the Development Officer, except that:
 
i. Fencing in the rear yard, adjacent to 107 Avenue, shall not exceed a height of 1.2 m and shall not encroach onto road right-of-way.
ii. Fencing in the side and rear yards adjacent to the abutting property to the south, shall not be less than 1.8 m in height.
t.The garbage collection area shall be screened with a wood enclosure and located entirely on private property. If gates and/or doors are provided they shall not open or encroach onto road right-of-way. The garbage collection area shall be located in accordance with Appendix I.
u.A Freestanding On-premises Sign consisting of lettering on a rock with a maximum height of 1.4 m, a maximum width of 1.9 m, and a maximum depth of 0.3 m shall be permitted and shall be located in accordance with Appendix I to the satisfaction of the Development Officer. No additional Signs shall be permitted.
v.Minor Home Based Business and Major Home Based Business shall comply with Sections 74 and 75 of this Bylaw, respectively.
w.Secondary Suites shall comply with Section 86 of this Bylaw.
