Empire Park - northwest corner of 48A Avenue and Calgary Trail Southbound

To establish a Site Specific Development Control District to accommodate convenience commercial and office uses, generally consistent with the provisions of a previously approved DC1 District which has now expired, and to develop sensitive site development regulations to ensure compatibility with adjacent land uses.

This DC5 District shall apply to Lot 6, Block 1, Plan 812 1222; located at the northwest corner of 48A Avenue and Calgary Trail Southbound, Empire Park, Duggan.

i. Minor and Major Eating and Drinking Establishments (with accessory food pickup window)

k. Professional, Financial and Office Support Services
a. The maximum floor area ratio shall be 1.0.
b. The maximum building height shall not exceed 10 m (32.8 ft.) nor two and one half storeys.
c. A minimum landscaped yard of 6 m (19.7 ft.) shall be provided adjacent to Calgary Trail Southbound.
d. A minimum landscaped yard of 6 m (19.7 ft.) shall be provided adjacent to the western boundary of the site. Within this yard, solid green fencing to a height of 1.85 m (6.1 ft.) shall be provided and located at approximately the midpoint of the yard. Evergreen and deciduous trees shall be planted on both sides of the fence. The landscaped yard and fencing shall be provided concurrent with the first stage of development on the site.
e. A minimum landscaped yard of 3 m (9.8 ft.) shall be provided adjacent to the southern boundary of the site.
f. No parking, loading, storage, trash collection, outdoor service or display area shall be permitted within a required yard. Loading storage and trash collection shall be located to the rear or sides of the principal building and shall be screened from view from any adjacent sites and public roadways in accordance with the provisions of Section 69.3 of the Land Use Bylaw.
g. The maximum gross floor area of any individual business premise for a Convenience Retail store shall not exceed 275 m2 (2,960.07 sq. ft.).
h. The maximum gross floor area of any individual business premise for a General Retail Store shall not exceed 465 m2 (5005.38 sq. ft.).
i. Development in this district shall comply with the following architectural guidelines:
 
i. exterior building finishes shall consist of brick, cedar, split stone concrete or precast concrete materials used either separately or in combination;
ii. building roofs shall be finished in cedar shakes, cedar siding, asphalt shingles or clay tiles, unless the roof is concealed from view by other building details such as a parapet wall, when viewed at normal eye level; and
iii. all mechanical equipment on the roof on any building shall be completely screened or incorporated within the building roof.
j. Gas Bars shall be developed in accordance with Section 82 of the Land Use Bylaw and in addition, a canopy shall be located over the gas pump islands to ensure that illumination is directed downwards and away from direct view by adjacent residential uses. Such a canopy shall be designed and finished in a manner consistent with the design and finishing of the principal building.
k. Drive-in Food Services shall comply with Section 82 of the Land Use Bylaw and the circulation for the accessory food pickup window shall be provided to the satisfaction of the Development Officer, in consultation with the City Engineer, so as to minimize the amount of traffic circulation in the rear portion of the site and minimize conflicting traffic movements on the site.
l. Development in this district shall be evaluated with respect to compliance with the General Development Regulations of Section 5079 inclusive of the Land Use Bylaw. In this evaluation, the Development Officer may grant relaxations to these regulations and the provisions of this District, if, in his opinion, such a variance would be in keeping with the general purpose of this district and would not affect the amenities, use and enjoyment of neighbouring properties.
m. Major and Minor Alcohol Sales shall be developed in accordance with Section 98 of the Land Use Bylaw.
