McCauley - south side of 107A Avenue, between 96 Street and 97 Street

To accommodate a limited range of low intensity business uses as well as apartment housing uses.  This Provision contains development regulations that will ensure that development is compatible with surrounding existing and future residential uses and a high standard of appearance appropriate to the site’s location in North Chinatown.

Lots 9 to 15 inclusive, Block 23, Plan D, located on the south side of 107A Avenue, between 96 Street and 97 Street, McCauley, as shown on Schedule ”A” of the Bylaw adopting this Provision.

a. Development shall be in accordance with the site plan as illustrated in Appendix 1.
b. The maximum total Floor Area Ratio shall be 1.0.
c. The maximum building Height shall not exceed 12 m nor 3 storeys.
d. The development shall provide a 2.4m wide sidewalk along the north edge of the building as shown on the Site Plan. The development shall also provide an expansion in width to the existing City sidewalk along 107A Avenue to the north of the Site Plan in the City right-of-way to a total of 2.4m of sidewalk width for pedestrian use. This expanded sidewalk will be provided by the developer as part of the development.
e. The following regulations shall apply to Apartment Housing:
i. Apartment Housing shall be permitted only in buildings where the first Storey is used for commercial purposes;
ii. each Dwelling shall have access at grade, which is separate from the access for the commercial premises;
iii. a minimum Amenity Area of 5 m2 per Dwelling shall be provided.
f. Development shall be in accordance with the following architectural guidelines, to the satisfaction of the Development Officer:
i. all exterior finishing materials must be of a high quality, durable and attractive in appearance; all exposed building faces shall have consistent and harmonious exterior finishing materials;
ii. on-site security and building lighting must provide a safe lit environment and ensure that the illumination is directed downwards and no direct rays of light are directed outward from the Site;
iii. all mechanical equipment on the roof of any building shall be concealed by screening in a manner compatible with the architectural character of the building, or concealed by incorporating it within the building roof;
iv. architectural details such as roofline, style, shape, colour and materials should be used to strengthen the identity of Chinatown North, as illustrated in the document entitled Avenue of Nations Design Guidelines. The east façade of the building shall have a treatment and consistent building profile as that of the front of the building; and
v. architectural treatment of the development shall ensure that the commercial areas have windows on the front façade of the building, and that the placement and type of windows shall allow viewing into the building.
g. Vehicular access to the Site shall be provided by an existing access to Lot B, Block 23, Plan D from 107A Avenue and by an existing lane access through Lot B, Block 23, Plan D as shown on Appendix 1.
h. Signs shall comply with Schedule 59D of the Zoning Bylaw.
i. It shall be a condition of the issuance of a development permit for a minor alcohol sales use, that there be no alcohol sales operations on the commercial site to the west of the subject site.
