Empire Park - south of 51 Avenue and east of 104A Street

Bylaw 13648 (May 11, 2004)

To accommodate the development of low and medium rise residential apartment housing, and establish development regulations that will achieve compatibility with the low and medium density residential uses to the west and south, and provide walkway and vehicular connections to the abutting commercial development.

A portion of Lot 4, Block 1, Plan 762 0205, containing 1.34 ha; located south of 51 Avenue and east of 104A Street, Empire Park, as shown on Schedule "B" Map of this Bylaw, adopting this Provision

a. The site layout and building locations shall be generally in accordance with the Site Plan as illustrated in Appendix I. The site layout and building locations shall be generally in accordance with the Site Plan as illustrated in Appendix I.
b. The maximum Density shall be 164.2 dwelling units per ha.
c. The maximum number of dwelling units shall be 220 units of which no more than 55 shall be two-bedroom units.
d. The maximum Height shall not exceed 4 storeys (14 m), nor 5 storeys (17 m), in accordance with the Site plan as illustrated in Appendix I.
e. The maximum Floor Area Ratio shall be 1.55.
f. A minimum landscaped yard of:
 
i. 6.0 m shall be provided on the north property line and developed in accordance with Section 55 of the Edmonton Zoning Bylaw, excepting those portions of the yard utilized for roadway, parking, garbage enclosure, and walkway connections, as illustrated in Appendix I.
ii. 6.0 m shall be provided on the west property line, and provide 6 mature deciduous trees (a minimum Caliper of 8cm), 4 coniferous trees (a minimum of 2.5 m in Height), and a minimum of 20 shrubs planted in raised shrub beds for each 30 m of frontage; with the plantings to be grouped in modules not greater than 25 m in length, to the satisfaction of the Development Officer
iii. 6.0m shall be provided on the east property line, and developed in accordance with Section 55 of the Edmonton Zoning Bylaw, and include a 1.8m high solid screen fence along its entire length, to the satisfaction of the Development Officer, and
iv. 7.5 m shall be provided on the south property line, and provide a 1.8 m high solid screen fence, a minimum of 30 deciduous trees (a minimum Caliper of 8 cm), 30 coniferous trees (a minimum of 3m in Height), and shrub planting to the satisfaction of the Development Officer, in accordance with the Site Plan as illustrated in Appendix I.
g. Separation Space requirements for habitable room windows facing required yards and onto the perimeter of the property shall be provided in accordance with Section 48 of the Edmonton Zoning Bylaw. The Development Officer may grant variances to reduce other separation space requirements contained in Section 48 of the Edmonton Zoning Bylaw pursuant to Section 48.1.8. of the Edmonton Zoning Bylaw.
h. No outdoor parking, loading, storage, or trash collection areas shall be permitted within a required Yard, excepting the visitor parking and garbage enclosure within the landscaped yard along the north property line which shall be developed as illustrated in Appendix I. All parking, loading, and trash collection areas shall be located in such a manner as to be screened from view from adjacent sites and public roadways in accordance with Section 54 of the Edmonton Zoning Bylaw.
i. No loading, storage, and trash collection areas shall be permitted within a distance of 30 m from the south property line of the site.
j. Development will include articulation in the building façades, and roof lines to minimize the perception of building massing and add architectural interest when viewed from abutting and adjacent development and roadways in accordance with the Building Perspectives as illustrated in Appendix II.
k. All exterior finishing material must be of a high quality, durable, and attractive in appearance; and all exposed building faces shall have consistent and harmonious exterior finishing materials, which may include elements of stucco complimented with stone cladding. These materials shall be compatible with the exterior finishing materials and colours typical of existing residential uses in the area.
l. To ensure a high standard of development, building design plans shall be submitted with development permit applications. Such plans, shall be to the satisfaction of the Development Officer and include details of overall site layout, exterior building treatment and colour scheme, perimeter and internal landscaping, fencing and screening, parking layout, and signage plans.
m. Vehicular access to the site shall be provided as illustrated in Appendix I.
n. Two Off-street Loading Facilities shall be provided as illustrated in Appendix I.
o. Signs shall comply with the regulations contained in Section 59B of the Edmonton Zoning Bylaw.
p. The minimum number of parking stalls shall be 314 of which 32 shall be for visitor parking.
a.Minor Home Based Businesses shall be developed in accordance with Section 74 of the Edmonton Zoning Bylaw.
b.Residential Sales Centres shall be developed in accordance with Section 82 of the Edmonton Zoning Bylaw.
