Bylaw 12291 (April 19, 2000)

To establish a Site Specific Development Control District to accommodate senior"s housing and an extended care lodge facility with associated commercial, residential-related, and community, educational, recreational and cultural services, and with site specific development regulations that will ensure compatibility with the adjacent land uses and a high standard of appearance appropriate to the site"s location in the French quarter.

This DC5 District shall apply to Lot 2, Block 2, Plan 792 0285, Bonnie Doon, as shown on Schedule "A" appended to the Bylaw adopting this District.

a. Development of the uses within 3.a and 3.b in this District shall comply with Section 220.4 of the Land Use Bylaw, except as otherwise stated in this section.
b. Maximum density of residential development shall be limited to 200 extended care, lodge and/or self contained housing units (maximum 100 self-contained housing units).
c. The maximum floor area for uses 3.c to 3.i shall be 10% of the floor area of the uses within 3.a and 3.b.
d. The maximum gross floor area of any individual use listed within 3.c to 3.h shall not exceed 275 m2 (2,960 square feet).
e. The maximum height of development shall be limited to five stories or 18.3 metres (60 feet).
f. Yards shall be established in accordance with the following:
g. Where the property abuts 84 and 85 Avenues, the minimum Yard shall be 4.5 metres (15 feet), except where provided for in 4.k.
h. Where the property abuts 91 Street, the minimum Yard shall be 6.1 metres (20 feet), except where provided for in 4.k
 
i. For each self-contained residential unit contained with the project, a minimum of one (1) off-street parking spaces shall be provided.
ii. For extended care or lodge-type units, a minimum of one (1) off-street parking spaces for each four units or portion thereof shall be provided.
iii. All required resident parking for the self-contained residential units shall be located underground.
iv. Primary access to and from the site shall be from 91 Street with only service and emergency access from the avenues.
i. To ensure that a high standard of appearance and a sensitive transition to the surrounding land uses are achieved, development in this District shall comply with the following architectural guidelines, to the satisfaction of the Development Officer:
 
i. all exterior finishing materials must be of good quality, durable, and attractive in appearance with consistent treatment on all faces of the building, utilizing materials and finishes in keeping with the buildings on surrounding properties;
ii. all mechanical equipment on the roof of any building shall be completely screened or incorporated in the building roof;
iii. lighting of the site shall be designed to create a safe, well-lit physical environment;
iv. any exterior lighting of the site shall be designed so that the lighting is directed away from the adjacent residential development to the south and north, and the intensity of illumination shall not extend beyond the boundaries of the site;
v. the perceived massing of the building when viewed from all sides shall be minimized through the use of varied building setbacks, articulation of the building façade and roof lines and the choice in colour of building materials. Porches, bay windows, balconies and other building features may project up to 2 m into yards to achieve this requirement
j.A Sun/Shadow Study meeting requirements of Section 16.3 shall be submitted by the applicant to the satisfaction of the Development Officer. The apartments and lodge facility shall not have adverse sun/shadow impacts on the adjacent residential development.
k.All existing mature trees on the periphery of the site shall be preserved. The building footprints and designs shall be such that they will not have an adverse negative impact on the viability of the trees.)
l.Development in this District shall be evaluated with respect to compliance with the General Development Regulations of Sections 50 to 79 inclusive of the Land Use Bylaw.
