Northmount - 13723  93 Street NW

Bylaw 11785 (July 13, 1998)

To establish a Site Specific Development Control District for a low intensity, professional office development that may include a single apartment dwelling unit, and is compatible with the adjacent single family residential development.

This DC5 District shall apply to Lot 50, Block 14, Plan 1294 T.R., located on the east side of 93 Street, north of 137 Avenue, with the municipal address of 13723  93 Street, Northmount.

a. Professional Offices
b. Apartment Housing
a. Apartment housing shall be limited to one dwelling unit.
b. If Apartment Housing is included, it shall only be permitted on the second storey where the first storey is used for professional offices.
c. The apartment dwelling unit shall have access at grade which is separate from the access for the professional offices.
d. The maximum total site coverage shall not exceed 40%, with a maximum of 28% for a principal building and a maximum of 12% for accessory buildings. Where a garage is attached to or designed as an integral part of a dwelling, the maximum for the principal building shall be 40%.
e. The maximum building height shall not exceed 8.5 m (27.9 ft.) nor two storeys.
f. The maximum height of an attached garage shall not exceed 3.7 m (12.0 ft.) or 1 storey.
g. A side yard with a minimum width of 1.2 m (3.94 ft.) shall be required along that part of the site that abuts Lot 51, Block 14, Plan 1294 T.R. except that this side yard shall be increased to a minimum of 2 m (6.6 ft.) if the building height exceeds 7.5 m (24.6 ft.); furthermore, the side yard abutting Lot 51 shall have a minimum width of 3.0 m (9.8 ft.) in front of the principal building.
h. A side yard with a minimum width of 3 m (9.8 ft.) shall be required on that portion of the site that abuts Lot 49, Block 14, Plan 1294 T.R. to provide for vehicular access to the parking spaces at the rear of the site.
i. A rear yard with a minimum depth of 7.5m (24.6 ft.) shall be provided.
j. A front yard with a minimum depth of 6m (19.7 ft.) shall be required.
k. Screening shall be required within the yard abutting the north/south lane, as well as the yard abutting Lot 51, Block 14, Plan 1294 T.R., and shall include a 1.8 m (6 ft.) solid uniform screen fence and mature planting, for the purpose of visually screening/separating the development from the adjacent uses, to the satisfaction of the Development Officer.
l. Landscaping plans shall be submitted in accordance with Section 69 of the Land Use Bylaw and the following additional requirements: a minimum landscaped front yard of 4.5 m shall be provided; those portions of the rear and side yards not required for parking or vehicular access shall be landscaped; and, the landscape treatment of the front yard shall be similar to adjacent residential properties, to the satisfaction of the Development Officer..
m. Urban design techniques shall be utilized to ensure, to the satisfaction of the development officer, that the appearance of the development is compatible with the surrounding single detached residential development. These shall include, but not be limited to, such techniques as sloped roof treatment, window details and the use of exterior materials and colours that are normally associated with single detached residential development.
n. The main public entrance to the building located on the site shall not face or be oriented towards Lot 51, Block 14, Plan 1294 T.R.
o. A total of 9 off-street parking spaces shall be provided on the site, with a maximum of 4 parking spaces in front of the building and the remainder to the rear of the building.
p. Direct vehicular access on to the site shall only be allowed from 93 Street and there shall be no vehicular access to/from the north/south lane.
q. No parking, loading, storage, outdoor service or display area shall be permitted within a required yard, except that parking shall be permitted in the required yard abutting Lot 49, Block 14, Plan 1294 T.R. and in the required yard abutting the north/south lane, and in the yard abutting 93 Street. No trash collection shall be permitted within a required yard, except for the rear yard abutting the north/south lane. Loading, storage and trash collection areas shall be screened from view from any adjacent residential site and public roadway, including the lane, in accordance with the provisions of Section 69.3 of the Land Use Bylaw.
r. Signs shall be allowed in this district in accordance with Schedule 79(D) and the general provisions of Sections 79.1 to 79.9 inclusive, of the Land Use Bylaw.
s. Development in this district shall be evaluated with respect to compliance with the General Development Regulations of Sections 50 to 79, inclusive, of the Land Use Bylaw.
t. The Development Officer may grant relaxations to Sections 50 to 79, inclusive, of the Land Use Bylaw and the provisions of this District, if, in his opinion, such a variance would be in keeping with the General Purpose of this District and would not affect the amenities, use, enjoyment and value of neighbouring properties.
