Michael's Park - 4404 - 66 Street

Bylaw 11182 (February 12, 1996)

 

To provide a site specific development control district to accommodate general business development on the site as well as a Vehicle Body Repair and Paint Shops Use which is accessory to an Automotive and Minor Recreational Vehicle Sales/Rentals Use.

This DC5 District shall apply to Lot 26 A, Block 34, Plan 872 2358, located at 4404 - 66 Street, Michael's Park, Mill Woods.

k. Minor Eating and Drinking Establishments
l. Minor Second-hand Stores with a gross floor area less than 275 m²
m. Minor Service Stations
n. Personal Service Shops
o. Professional, Financial and Office Support Services
p. Spectator Entertainment Establishments
q. Vehicle Body Repair and Paint Shops, as an accessory use to Automotive and Minor Recreational Vehicle Sales/Rentals
a. The maximum Floor Area Ratio shall be 1.0.
b. A minimum yard of 4.5 m shall be required where the site abuts the east property line adjacent to 66 Street.
c. A minimum yard of 3 m shall be required where the site abuts the north property line adjacent to Whitemud Drive.
d. A minimum yard of 4.5 shall be required adjacent to the west property line where the site abuts a lane in a residential district.
e. In addition to the minimum yard required by Clause 4(d) above, a minimum building Setback of 15 m shall be required from the west property line that abuts a residential area for all buildings, structures and accessory parking garages other than at-grade parking lots. This minimum building Setback may be reduced to 10 m at the discretion of the Development Officer, where, in his opinion, the location of drive aisles and the provision of landscaping, fencing, berming, building facade treatment or other design features adequately protect the amenities of nearby residential areas.
f. No yard is required on the south property line where the site abuts a commercial district.
g. A minimum building setback of 8.0 m shall be required from the pipeline right-of-way (Plan 3783 HW) located in the southeast portion of the site.
h. All surface disturbances on or within the vicinity of the pipeline right-of-way (Plan 3783 HW) shall be undertaken in a manner acceptable to the pipeline operator and be in accordance with the Pipeline Crossing Agreement between the developer and the pipeline operator.
i. No vehicle access shall be allowed from the site to the lane adjacent to the west boundary of the site.
j. 1.83 m high screen fencing shall be required adjacent to the entire west property line in order to screen the site from the residential area to the west.
k. The landscaping requirements of Section 69.4 Clause (7) of the Land Use Bylaw shall not apply to the West Yard adjacent to the residential area. Instead the following landscaping shall be required within or adjacent to the West Yard:
 
i. one shrub for each 15 sq. m of Required West Yard and to be located within this Yard.
ii. in order to screen any buildings from the residential area to the west of the site, one tree will be required per 5.5 m of linear building wall facing the residential area. These trees may be located to the east of the Required Yard.
iii. three groupings of trees each with a minimum of five trees. These groupings shall be within 12 m of the west property line. If these trees are within a parking island, the parking island shall be a minimum of 14 sq. m. in area.
l. No parking, loading, storage, trash collection, or outdoor service shall be permitted within a required Yard. Loading, storage and trash collection areas shall be located to the rear or sides of the principal building and shall be screened from any adjacent sites or public roadways in accordance with the provisions of Section 69.4 of the Land Use Bylaw.
m. The maximum building height shall not exceed 14m nor 4 storeys.
n. The following regulations shall apply to Automotive and Minor Recreational Vehicle Sales/Rentals, and Convenience Vehicle Rental development:
 
i. all storage, display or parking areas shall be hard surfaced in accordance with Section 67.3 of the Land Use Bylaw;
ii. all display areas which abut a Residential District or a lane serving a Residential District shall be screened in accordance with the provisions of Section 69.4 Clause (4) of the Land Use Bylaw; and
iii. lighting for the display areas shall be mounted on lamp standards, with no exposed bulbs or strings of light and with the lighting directed away from the residential area to the west of the site.
o. Vehicle Body Repair and Paint Shops shall comply with the following:
 
i. the performance standards of Section 73 of the Land Use Bylaw for industrial development, including the requirements of the IB District under Section 73.2 Clause (4a);
ii. the accessory Vehicle Body Repair and Paint Shop shall be located within the principal building accommodating the Automotive and Minor Recreational Vehicle Sales/Rental use; and
iii. overhead doors servicing the Vehicle Body Repair and Paint Shop shall be oriented towards the north or south property lines.
p. Signs shall be allowed in this district as provided for in Schedule 79E and in accordance with the general provisions of Section 79.1 to 79.9 inclusive of the Land Use Bylaw.
