Bylaw 10907 (December 5, 1994)

To provide a Site Specific Development Control District to accommodate an innovative form of family-oriented housing that incorporates three dwelling units on the lot. The intent is to provide attractive and affordable housing for families that minimizes negative impacts on the adjacent land uses.

Lot 4, Block D, Plan 3837W, Balwin

a. Three Dwellings consisting of a Single Detached Dwelling facing the front street and Duplex Housing towards the rear of the lot, with both buildings separated by a central outdoor courtyard.
b. Minor Home Occupations.

The following regulations shall apply to the use:

a. Development and landscaping on this site shall generally be similar to the design and site plan shown in Appendix I to this District.
b. The minimum site area shall be 390 m2 (4200 ft2).
c. The minimum site width shall be 10.67 m (35 ft.).
d. The minimum site depth shall be 36.58 m (120 ft.).
e. The maximum building Height shall not exceed 7.0 m (23 ft.) nor 2 storeys.
f. A common outdoor courtyard approximately 7.0 m (23 ft.) by 7.0 m (23 ft.) shall be located between the two buildings.
g. The maximum total site coverage shall be 40%.
h. The minimum Front Yard shall be 4.9 m (16 ft.). A covered one-storey veranda may extend 2.4 m (8 ft.) into the Front Yard.
i. The minimum Rear Yard shall be 7.5 m (24.6 ft.).
j. The minimum Side Yard shall be 1.2 m (4 ft.) on the south side of the lot and 2.1 m (7 ft.) on the north side of the lot. On the building located towards the rear of the lot, an outside covered stairway may extend 0.91 m (3 ft.) into the north Side Yard and a deck at the top of this stairway on the second storey may extend 1.83 m (6 ft.) into the north Side Yard.
k. A total of three outdoor parking spaces shall be provided in the Rear Yard. Access to parking shall be from the rear lane. There shall be no parking in the required Front Yard. There shall be no garages, carports or other structures to cover a vehicle(s).
l. A strong sense of entry shall be created on the front facade. At least one principal entrance shall be clearly visible from the front street.
m. Landscaping shall be in accordance with Section 69 of the Land Use Bylaw except that:
 
i. at least two trees, a minimum 50 mm (0.16 ft.) caliper for deciduous trees and 2.5 m (8.2 ft.) in height for coniferous trees, shall be located in the front yard;
ii. the outdoor courtyard shall be landscaped to provide privacy to the individual dwellings on the site as generally indicated in Appendix I;
iii. a fence, a maximum of 1.85 m (6.1 ft.) in height shall be built along the side property lines in accordance with Section 60 of the Land Use Bylaw where the Single Detached Dwelling will be considered the principal building;
iv. the trash collection area shall be screened to block the view from any adjoining residential uses.
n. A Minor Home Occupation shall be developed in accordance with Section 84 of the Land Use Bylaw.

Bylaw attachments
