Lauderdale - east side of 101 Street and north of 132 Avenue.

Bylaw 9101 (March 28, 1989)

To establish a Site Specific Development Control District to accommodate an automotive repair facility, and to exclude all other uses other than the repair of automobile brakes, for the operation of Brake Check, and to establish sensitive site development criteria to ensure that development will be compatible with surrounding low density residential land uses.

This DC5 District will apply to Lot 14, Block 10, Plan 618 KS; located on the east side of 101 Street and north of 132 Avenue, Lauderdale.

Automotive and Equipment Repair Shop, for the sole purpose of accommodating Brake Check, and restricted solely to brake repair.

a. The maximum floor area ratio shall be 0.30.
b. The maximum building height shall not exceed 7.6m (25.0 feet) nor one storey.
c. The general site layout and building location shall be substantially in accordance with the site plan as illustrated in Appendix I to Schedule B of Bylaw 9101.
d. A landscaped yard, a minimum of 3.0m (9.8 feet) in width shall be provided adjacent to 132 Avenue. The existing trees and hedge located adjacent to 132 Avenue shall be retained except that portion required for a single site access from 132 Avenue not to exceed a width of 7.5m (24.6 feet). Additional coniferous trees, a minimum height of 3.0m (9.8 feet) together with a mix of deciduous and coniferous shrubs shall be provided on the eastern portion of this yard, to the satisfaction of the Development Officer.
e. A landscaped yard, a minimum of 6.1m (20.0 feet) in width shall be provided adjacent to 101 Street, together with a 1.2m (4.0 feet) high cedar fence to be located at a distance of 6.1m (20.0 feet) from the property line. Existing coniferous trees shall be retained in the northern portion of this yard. Two mature coniferous trees, a minimum height of 3.0m (9.8 feet) shall be planted in the southern portion of this yard to the satisfaction of the Development Officer. In addition, a mix of deciduous and coniferous shrubs shall be provided for the entire yard so as to provide a substantial screen, to the satisfaction of the Development Officer.
f. Where the trees to be retained do not survive in the long term, they shall be replaced with mature coniferous trees, a minimum height of 3.0m (9.8 feet) and with a maximum spacing of 4.5m (14.7 feet), to the satisfaction of the Development Officer.
g. A landscaped yard, a minimum of 3.0m (9.8 feet) in width shall be provided adjacent to the south boundary of the site, together with a 1.8m (6.0 feet) high cedar fence to be located on the property line. The fence shall not encroach into the 6.1m yard provided adjacent to 101 Street. Landscaping shall consist of one mature coniferous tree, a minimum height of 3.0m (9.8 feet) for every 4.5m (14.7 feet) of linear yard and shall be provided to the satisfaction of the Development Officer.
h. Landscaping, fencing, and hardsurfacing of the parking area shall be completed with the first phase of development on the site.
i. Vehicular access shall be allowed to the site from only 132 Avenue and the north/south lane located to the east of the site.
j. Development in this District shall comply with the following architectural guidelines:
 
i. the exterior finishing materials shall be limited to brick of a residential scale and character and restricted to muted earth tones, compatible with the adjacent residential neighbourhood. Consistent treatment must be maintained on all faces of the building.
ii. a sloped roof shall be provided on all sides and the roof materials shall be limited to cedar shakes; and
iii. any mechanical equipment on the roof of the building shall be completely incorporated in the building roof.
k. No parking or loading shall be permitted within a required yard. There shall be no outdoor storage and trash collection areas shall be located in such a manner as to be screened from view from adjacent residential sites and public roadways in accordance with the provision of Section 69.3 of the Land Use Bylaw.
l. A minimum number of six parking stalls shall be provided on site.
m. Exterior lighting of the entire site shall be provided and designed so that the lighting is directed away from the adjacent low density residential development to the northwest, west and south, and the intensity of illumination shall not extend beyond the boundaries of the site. Security lighting for the western and southern portions of the site shall be designed in consultation with the adjacent property owners and to the satisfaction of the Development Officer.
n. To ensure that a high standard of appearance and a sensitive transition to the surrounding land uses are achieved, detailed landscaping plans shall be submitted with the initial development permit application for approval by the Development Officer which, in the opinion of the Development Officer, comply with the planting, screening and fencing detail requirements specified by Clauses 4d), 4e), 4f) and 4g) of this District.
o. The Development Officer shall require, as a condition of approval, that the applicant provide an irrevocable letter of credit or a performance bond in the amount of the established landscaping cost, the conditions of the security being that:
 
i. if the landscaping is not completed in accordance with the provisions of the District and the landscaping plan within one growing season after the completion of the development, then the amount fixed shall be paid to the City for its uses absolutely; and
ii. the Development Officer shall not release the Landscaping Bond until an inspection of the site has demonstrated that the landscaping has been well maintained and is in healthy condition two growing seasons after completion of the landscaping.
p. Signage on the site shall be limited to one fascia sign and one free standing sign. The free standing sign shall be located in the northeasterly portion of the site adjacent to 132 Avenue and shall not exceed a vertical height of 7.0m (23.0 feet) and an area of 14.0m2 (150.6 ft.). The fascia sign shall provide for business identification only and shall be located on the northern face of the building between the top of the glass doors and the bottom edge of the roof and shall not exceed a maximum length of 7.5m (24.6 feet). Sign details shall be submitted with the initial development permit application for approval by the Development Officer which, in the opinion of the Development Officer, comply with the above-noted provisions.
q. Development in this District shall be evaluated with respect to compliance with the General Development Regulations of Sections 50-79 inclusive of the Land Use Bylaw.
r. The Development Officer may grant relaxations to Section 50-79 of the Land Use Bylaw and the provisions of this District, if, in his opinion, such a variance would be in keeping with the general purpose of this District and would not affect the amenities, use, and enjoyment of neighbouring properties.
