Bylaw 9040 (February 28, 1989)

To establish a Site Specific Development Control District to accommodate a two level parkade designed to complement the operations of the automotive dealership located on Lots 26 to 36, inclusive, Block 131, Plan IV, such that, by developing sensitive site development regulations, impacts on surrounding residential areas are minimized.

This DC5 District shall apply to Lots 1 to 11, inclusive, Block 131, Plan IV, located west of 107 Street, north of 81 Avenue, Garneau.

Accessory Parking in the form of a 2 level parkade to be used exclusively for the Automotive Dealership located on Lots 26 to 36, inclusive, Block 131, Plan IV.

a. The site layout shall be in general accordance with the site plan illustrated in Appendix I to this District.
b. The maximum floor area ratio shall be 1.5.
c. The maximum building height shall not exceed 5 m (16.4 ft.) nor 2 storeys.
d. The following landscaped yards shall be provided: A yard, a minimum of 6.1 m (20 ft.) in width shall be provided along 81 Avenue; a yard, a minimum of 4.5 m (14.76 ft.) shall be provided along 107 Street; and a yard, a minimum of 3.65 m (12 ft.) shall be provided along the west property line. Landscaping therein shall consist of a mixture of coniferous and deciduous trees, and evergreen shrubs planted to enhance the parkade and to substantially screen the parkade from the adjacent residential areas. Deciduous trees shall have a minimum caliper of 8 mm and coniferous trees a minimum height of 3 m. These groupings shall be provided to the satisfaction of the Development Officer.
e. A minimum building setback of 1.52 m (5 ft.) shall be provided along the north property line, abutting the lane.
f. A detailed landscaping plan for the entire project, generally in accordance with the site plan contained in Appendix I, shall be submitted to and approved by the Development Officer prior to the approval of any development permit. These plans shall include details of sizes and species of new plantings, soil depth, grade changes and any provisions to facilitate natural plant growth; exterior lighting, pedestrian seating areas, and details of any paving materials.
g. The Development Officer shall require, as a condition of approval, that the applicant provide an irrevocable letter of credit or a performance bond, in the amount of 100% of the established landscaping cost, the conditions of a security being that:
 
i. if the landscaping is not completed in accordance with the provisions of this District and the landscaping plan, within one growing season after the completion of the development, then the amount fixed shall be paid to the City, for its use absolutely; and
ii. the Development Officer shall not release the Landscaping Bond until an inspection of the site has demonstrated that the landscaping has been well maintained and is in a healthy condition two growing seasons after completion of the landscaping.
h. Vehicular access and egress to and from the site will be restricted to the abutting lane, with grade access to the ground level and ramp access to the upper level from the lane.
i. Details of the proposed ramp/bridge linking the proposed parkade to the upper level roof parking of the automotive dealership to the north must be submitted to and approved by the General Manager of the Transportation Department at the development permit stage.
j. No parking, loading, storage, trash collection, outdoor service or display areas shall be permitted within a required yard. Loading, storage and trash collection areas shall be located to the north side of the parkade and shall be screened from view from any adjacent residential sites or public roadways, in accordance with Section 69.3 of the Land Use Bylaw.
k. Development in this District shall be in accordance with the following architectural guidelines, to the satisfaction of the Development Officer:
 
i. all exposed sides of the parkade shall be finished in a consistent, harmonious manner, and shall include design elements that will reduce the perceived mass and linearity of the project, and add architectural interest; and
ii. the exterior finishing materials shall consist of light coloured brick, stone or other masonry materials having a similar character, or cedar, to ensure that the development is compatible with the adjacent residential buildings in the area.
l. Appropriate lighting of the project shall be undertaken to provide security to the parkade and the proposed seating areas and to add visual interest. Lighting shall be directed downwards and away from the residential areas and from the adjacent roadways. No exposed bulbs or strings of lights shall be used.
m. No signage shall be allowed on the parkade structure. Directional Signs shall be allowed only at the entrances to the structure and shall not exceed a height of 1.5 m or a maximum area of 1 m2.
n. Development in this District shall be evaluated with respect to compliance with the General Development Regulations of Sections 50-79 inclusive of the Land Use Bylaw.
o. The Development Officer may grant relaxations to Sections 50-79 inclusive, of the Land Use Bylaw and the provisions of this District, if in his opinion, such a variance would be in keeping with the general purpose of this District and would not affect the amenities, use and enjoyment of the neighbouring properties.
