Terra Losa - east of 178 Street and north of 98A Avenue

Bylaw 9011 (November 22, 1988)

To provide a Site Specific Development Control District to accommodate religious assembly, private education services and related accessory uses with development criteria that will ensure that development will be compatible with the surrounding residential and industrial business uses, and the Terra Losa Site Design, Landscape and Architectural Guidelines and the Terra Losa Land Use and Development Restricted Covenant Caveat Schedule, as amended, being part of Bylaw 6616.

This District shall apply to Lots 5, 6 and 7, Block 2, Plan 872-2350, located east of 178 Street and north of 98A Avenue, Terra Losa, West Jasper Place.

a. Religious Assembly.
b. Daytime Child Care Services, Private Education Services and Community Recreation Services when designed as an integral and secondary component of a Religious Assembly.
a. The maximum floor area ratio shall not exceed 0.4.
b. The maximum building height shall not exceed 15 m nor 3 storeys.
c. A landscaped yard, a minimum of 6 m in width shall be provided adjacent to 98A Avenue. Landscaping adjacent to the areas used for parking will be in accordance with the Terra Losa Site Design, Landscape and Architectural Guidelines. The remaining portion of the site adjacent to 98A Avenue will be landscaped with one landscape Module B and one landscape Module A alternating along the street frontage in accordance with the Terra Losa Land Use and Development Restrictive Covenant Caveat Schedule and the Terra Losa Site Design, Landscape and Architectural Guidelines.
d. A landscaped yard, a minimum of 7.5 m in width, shall be provided adjacent to the east property line of Lot 7 and shall be landscaped with Landscape Module A in accordance with the Terra Losa Land Use and Development Restrictive Covenant Caveat Schedule and the Terra Losa Site Design, Landscape and Architectural Guidelines.
e. A landscaped yard, a minimum of 7.5 m in width shall be provided adjacent to the north property line. Such yard shall be landscaped and bermed in accordance with the Terra Losa Site Design Landscape and Architectural Guidelines.
f. A landscaped yard, a minimum of 6 m, shall be provided adjacent to 178 Street. Landscaping shall be provided in accordance with the Terra Losa Site Design Landscape and Architectural Guidelines.
g. A minimum building setback of 15 m shall be provided from the southern property line.
h. The portion of the site east of 178 Street to a minimum depth of 100 m shall be developed for surface parking for Religious Assembly and other uses specified in this District.
i. The most easterly 50 m of the site shall be used only for surface parking.
j. Not less than 300 parking spaces shall be provided in respect of the uses allowed on this site. The Development Officer, may require more than 300 parking spaces based on his review of the overall building program, for this site, in consultation with the City Engineer.
k. No parking, loading, storage, trash collection, outdoor service or display area shall be permitted within a required yard. Storage, loading and trash collection areas shall be located to the rear or sides of the principal buildings, and shall be screened from view from any adjacent sites and public roadways, in accordance with the provisions of Section 69.3 of the Land Use Bylaw.
l. Development in this District shall comply with the Terra Losa Land Use and Development Restrictive Covenant Caveat Schedule and Terra Losa Site Design, Landscape and Architectural Guidelines as well as the following architectural guidelines:
 
i. all exterior finishing materials must be of good quality, durable and attractive in appearance with consistent treatment on all faces of a building. No painted and/or scored concrete block construction will be permitted on any building facade directly facing any residential area;
ii. a harmonious architectural and landscaping theme shall be created through the exterior treatment of buildings (i.e., materials, colours and designs) on the site and through the use of landscaping techniques and planting materials, which are compatible with the residential context of the area; and
iii. buildings shall be designed and finished in a manner that minimizes the perceived massing of development when viewed from the residential lands to the south of the site, through the consideration of such factors as, the choice and colour of finishing materials, and the articulation of roof and building facade details.
m. All landscaping requirements shall be completed with the first phase of development.
n. The Development Officer shall require, as a condition of approval, that the applicant provide an irrevocable letter of credit or a performance bond, in the amount of 100% of the established landscaping cost, the conditions of the security being that:
 
i. if the landscaping is not completed in accordance with the provisions of this District and the landscaping plan, within one growing season after the completion of the development, then the amount fixed shall be paid to the City, for its use absolutely; and
ii. the Development Officer shall not release the Landscaping Bond until an inspection of the site has demonstrated that the landscaping has been well maintained and is in a healthy condition two growing seasons after completion of the landscaping.
o. Signs shall be allowed in this District as provided for in accordance with Schedule 79B and in accordance with the general provisions of Section 79.1 to 79.9 inclusive of the Land Use Bylaw, as well as the Terra Losa Land Use and Development Restrictive Covenant Caveat Schedule and Terra Losa Site Design, Landscape and Architectural Guidelines.
p. Development in this District shall be evaluated with respect to compliance with the General Development Regulations of Sections 50-79 inclusive of the Land Use Bylaw.
q. The Development Officer may grant relaxations to Sections 5079 of the Land Use Bylaw and the provisions of this District, if in his opinion, such a variance would be in keeping with the general purpose of this District and would not affect the amenities, use and enjoyment of neighbouring properties.
r. Development within this District including the provision of parking, may be phased, provided that the development permit for the first phase is accompanied by a comprehensive site plan showing the overall building program and phasing, to the satisfaction of the Development Officer.
a. Daytime Child Care Services shall be developed in accordance with Section 93 of the Land Use Bylaw and shall be located such that direct access at grade can be provided to an outdoor play area. The outdoor play area which shall be approved by the Development Officer in consultation with the General Manager of Social Services, shall be located away from vehicular-oriented uses and from parking and loading areas on the site and shall be enclosed by building walls or screen fences, a minimum of 1.8 m high.
b. For the purposes of this District, the Religious Assembly Use Class shall include provisions for the development of a library, bookstore, meeting rooms, kitchen, and a gymnasium as integral and accessory components of the principal Religious Assembly building and where such uses are intended primarily to serve the members of the Religious Assembly. Religious Assembly shall also comply with the following criteria:
 
i. the meeting rooms and gymnasium may be used for banquet facilities, not exceeding a seating capacity of 1000, intended for the members and ministries of the Religious Assembly; and
ii. the maximum seating capacity of the sanctuary shall not exceed 2,100 persons.
