Patricia Heights - south of 76 Avenue and west of 158 Street

Bylaw 8432 (March 24, 1987)

To establish a Site Specific Development Control District to accommodate single detached dwellings, with site development regulations which will ensure compatibility with surrounding residential land uses and the adjacent ravine.

Lot 1, Block 2A, Plan 4942 R.S., south of 76 Avenue and west of 158 Street, Patricia Heights.

a. The maximum number of dwellings allowed in this District shall be 5.
b. The minimum site area shall be 360 m2 for each Single Detached Dwelling.
c. The minimum site width shall be 10 m for each Single Detached Dwelling.
d. The minimum site depth shall be 30 m.
e. The maximum height shall not exceed 10 m nor 2½ storeys.
f. The maximum total site coverage shall not exceed 40%, with a maximum of 28% for a principal building and a maximum of 12% for accessory buildings. Where a garage is attached to or designed as an integral part of a dwelling, the maximum for the principal building shall be 40%.
g. The minimum gross floor area for any single detached dwelling shall be 139 m2 of which a minimum of 93 m2 shall be contained within the main floor.
h. The minimum front yard shall be 3.0 m.
i. The minimum rear yard shall be 7.5 m.
j. Side yards shall be established on the following basis:
 
i. Side yards shall total at least 20% of the site width, with a minimum side yard of 1.2 m, except that the minimum side yard for buildings over 7.5 m in height shall be 2 m.
ii. Where there is no lane abutting he site, one side yard shall be at least 3 m wide or vehicular access, unless there is an attached garage or a garage which is an integral part of a building.
iii. On a corner site where the building fronts on the front yard the minimum side yard abutting the flanking public roadway other than a lane shall be 20% of the site width o a maximum of 4.5 m.
iv. On a corner site where the building fronts on a flanking public roadway other than a lane, the minimum side yard abutting the flanking public roadway shall be 4.5 m.
k. The minimum setback for development adjacent to the surveyed top of bank shall be 7.5 m, and this setback may be increased by the Development Officer pursuant to Sections 16.1 and 811 of the Land Use Bylaw.
l. Separation Space shall be provided between two or more dwellings or portions thereof on the same site, in accordance with the Section 58 of this Bylaw.
m. A continuous 1.8 m high solid wood and brick screen fence shall be erected adjacent to 76 Avenue (except for that portion required for Cul-De-Sac access) and adjacent to 158 Street.
n. Dwellings shall be finished with low maintenance, high quality finishing materials of muted colours. The building roofs shall be finished with cedar shakes, asphalt shingles or clay tiles. The buildings on the site shall be designed and finished so as to achieve an individuality of appearance within an overall design theme.
o. Developments in this District shall be evaluated with respect to compliance with the General Development Regulations of Sections 50 to 79 inclusive of the Land Use Bylaw.
p. The Development Officer may grant relaxations to the regulations contained in Sections 50 through 70 of the Land Use Bylaw and the provisions of this District, if in his opinion such a variance would be in keeping with the District and would not adversely affect the amenities, use, and enjoyment of neighbouring properties.
a. Offices-in-the-Home shall be developed in accordance with Section 84 of the Land Use Bylaw.
b. Homecrafts shall be developed in accordance with Section 85 of the Land Use Bylaw.
