To establish a Site Specific Development Control District for a gas bar and rapid drive-through vehicle services, such that by limiting the range of specific land uses and developing sensitive site development regulations, impacts on adjacent residential properties are minimized.

a. The maximum floor area ratio shall be 1.0.
b. The maximum building height shall not exceed 6 m nor 1 storey.
c. A minimum building setback of 6 m shall be provided adjacent 92 Avenue. A minimum of 3 m within this setback shall be landscaped.
d. A minimum landscaped yard of 3 m shall be provided adjacent to 156 Street, and 92A Avenue.
e. There shall be a minimum building setback of 3 m adjacent the east property line and a minimum of 1.5 m within this setback shall be landscaped, except that there shall be a minimum building setback of 5 m adjacent the east property line for the southerly 44.4 m of the east property line. A minimum of 1.5 m within this setback, west of the fence required by Section 4.6, shall be landscaped.
f. Continuous screen fencing of a solid design, a minimum of 1.8 m in height, shall be provided adjacent the north and east property lines. The most southerly 44.4 m of this screen fence shall be located a minimum of 1 m west of the existing east property line.
g. No parking, loading, storage, trash collection, outdoor service or display area shall be permitted within a required yard. Loading storage and trash collection areas shall be located to the rear or sides of the principal building and shall be screened from view from any adjacent sites and public roadways in accordance with the provisions of Section 69.3.
h. A canopy shall be constructed over the gas pump islands to ensure that illumination is directed downwards and away from direct view by adjacent residential uses. Such canopy shall be designed and finished in a manner consistent with the design and finish of the principal building and no portion of this canopy shall be allowed to project within the 5 m setback required in Section 4.5.
i. Any application for a development permit for a rapid drive-through vehicle service shall contain information regarding anticipated noise impacts of the development and shall also be accompanied by a statement from a qualified professional engineer indicating what noise attenuation measures, if any, are required to ensure that the proposed development will comply with the City of Edmonton Noise Bylaw 7255, as amended. The Development Officer may require as conditions of development permit approval that the applicant provide the noise attenuation measures recommended in the noise impact statement or any measures recommended by the City Engineer based on the noise impact statement.
j. Gas bars and Rapid Drive-through Vehicle Services shall be developed in accordance With Section 82 of the Land Use Bylaw.
k. The total maximum gross floor area for a convenience retail use shall not exceed an area of 23 m2 (248 sq. ft.).
l. Signs shall be allowed in this District as provided for in Schedule 79D and in accordance with the General provisions of Section 79.1 to 79.9 inclusive of the Land Use Bylaw.
m. Development in this District shall be regulated with respect to compliance with the General Development Regulations of Section 50 to 79 inclusive of the Land Use Bylaw. In this evaluation, the Development Officer may grant relaxations to the regulations contained in Sections 50 through 79 and the provisions of this District if, in his opinion, such a variance would not affect the privacy, amenities, use and enjoyment of neighbouring properties.
